2 березня 2026 року о 7.49 погруддя Кобзаря було цілеспрямовано на моїх очах прострелене з гармати російським СУ-34, який одразу після цього був збитий. Після деокупації Бородянки фото погруддя обійшло увесь світ і стало символом нескореності українців і нашої майбутньої перемоги. Побачити погруддя приїздять люди з усього світу, для яких я проводжу екскурсії і розповідаю цю історію. Тому я сфотографував волонтерок, які його обмивали від пилюки. Якщо ця історія дратує росіян і їх прихильників, то вибачайте - з пісні слів не викинеш. На жаль, після обстрілу всередину погруддя стала потрапляти волога, що призвело до корозії мідного листа. I hope you are doing well. I just wanted to share some updates. After tons of back and fourth with Bangladesh Copyright Office and other relevant stakeholders (and significant loss of my hair), I started public policy advocacy journey of Wikimedia Bangladesh. We have officially submitted a formal RfC with the copyright office about FOP. During our meeting, I raised your issue about Berne Convention compliance. Their explaination is that the law has been reviewed by the WIPO and fully compliant with all international agreement that Bangladesh has signed. This includes my proposal saying that architectural work in not directly protected. I did not push to know how it is compliant. All necessary paperwork is done and we are hopeful that we will get an official clarification. We just need the green light from the copyright register. That will take a month or two.

We also got an explanation why FOP was removed here. They wanted to reduce clutter in the official law and move the clauses to a separate "copyright rules" act. Due to some political turmoil that separate act is still in draft phase. I have also made sure that WMBD will be invited to stakeholder meeting of this act to advocate for open knowledge. @Tausheef Hassan understood. You mean, FoP will be transferred to the implementing rules and regulations? If so, Wikimedia Bangladesh should continue to call for the exact FoP wording to be incorporated in the implementing rules. Or, at the very least, outdoor works (outdoor sculptures, monuments and murals) and exteriors of buildings only, and any indoor work (like interior architecture, interior designs, indoor statues or sculptures, and interior 2D art like indoor paintings) can only be used for personal or non-commercial purposes, if excessive Freedom of Panorama might be more harmful than beneficial. @Tausheef Hassan by the way, is there an online text for the pending bill of the copyright rules act (that I assume will act as the supplement for the Copyright Act)? @JWilz12345: I won't be surprised if they haven't even started writing it yet. (Based on their pace, it might take more couple of years). I will ask for a draft copy if I go there again.
The previous "copyright rules 2006" is this File:কপিরাইট বিধিমালা, ২০০৬.pdf and only in Bengali. I am a bit confused on this regard. This 2006 rules is just a gazette about about how to register a copyright. It derives it's power the copyright act, 2000 and didn't required any vote from the parliament floor. But she said that the new act will go to the parliament and will include those sections. I didn't ask questions as it is more beneficial to me.
We are the first stakeholder to approach them about pictures/videos. So, they admitted that due to not having any stakeholder in this field, they do not have any idea about the ground situation. So, My idea is to give them a report based to DRs and include some concepts like COM:PPD, TOO, CCTV camera, coat of arms, free government works, De minimis, PD Art, PD Scan, PD maps, charts etc (feel free me to remind me something) Tausheef Hassan Auntu ✉Talk? 05:07, 21 June 2026 (UTC)Reply
@Tausheef Hassan understood. It's good to know that Wikimedia Bangladesh has become the first stakeholder for the public place exemption/Freedom of Panorama clause.
I would also suggest exempting works of the national government from copyright (similar to {{PD-USGov}}). Or, if that's not possible, something similar to the initiatives of some agencies/ministries of the Indian and Japanese governments, in which they have released their works in copyleft licensing but not sacrificing copyright (like {{GODL-India}} and {{PDL1.0}}).
Threshold of originality rules are typically judged by courts or relevant authorities (like copyright agencies or offices), since the copyright laws are just "baseline". You can find that on ToO sections of the copyright rules pages. For example, COM:TOO US (very high standard of ToO, denying copyright to many minimalist logos or designs), COM:TOO China (very low threshold, basic designs may be copyrightable), and COM:TOO UK. I think the Ministry of Planning is working on a OGL licence, only for certain data sets. but I don't think we can get national government work under a free license. I will be trying to negotiate some form of freely usable licence, but I don't have my hopes up. I have submitted a proposal to work on a list of issues with them and kept govt license at the top.
Another thing, I really wanna work on is en:The Azad. From what I understand by talking with the national library, the national archives and the copyright office is that, the news paper does not exist. There are no valid owners. It's a very useful and important piece of history. I currently maintain a small repo of the newspaper in a private wikimedia Bangladesh server. I really really want to host them on wikimedia commons. Currently private companies charge around 5 thousand usd for the collection. I am confident I can wriggle the copyright office into saying that they are PD as they have no owner and get the full collection from the national archives. But will it be URAA complient, is there any loophole. I can get WMBD to buy the rights of the azad, but no one knows who to buy it from. Tausheef Hassan Auntu ✉Talk? 07:18, 21 June 2026 (UTC)Reply

Hopefully FoP returns as a formal legal right in Bangladesh, at least either exterior architecture and outdoor monuments/sculptures, or architecture (exterior+interior) and outdoor monuments/sculptures. The outdoor-only FoP is similar to the FoP rules of Germany, of Hungary, or of Poland. The more lenient suggestion of mine, covering all buildings regardless of exterior or interior aspects plus outdoor-only monuments and sculptures, is similar to that of Austria. @Tausheef Hassan but I have to admit. I also live in a country that does not grant Freedom of Panorama: see COM:FOP Philippines. As seen in the progress page (meta:Pilipinas Panorama Community/Freedom of Panorama/Progress), there was an almost close call in the last Congress, with four pending bills containing FoP provision, one in the upper chamber or Senate and three in the lower chamber or the House of Representatives. Unfortunately, none of them were tackled and were left to "die" at the end of the Congress. In this 20th Congress, none of the intellectual property law amendment bills contain an FoP provision. I don't know if I can do much more, considering that I am a Chinese Filipino or Filipino-Chinese, not a full Filipino.
Additionally, here is one quote from meta:Education/News/June 2026/Growing Wiki Education in the Philippines: Highlights from Bikol WikiConference 2026, which made me realize myself to "not expect FoP being introduced here anytime soon."
